SOL: two years from diagnosis (12 Okla. Stat. § 95(A)(3)) Courts: Oklahoma County District Court (Oklahoma City), Tulsa County District Court (Tulsa) Oklahoma allows two years for a personal-injury claim (12 Okla. Stat. § 95(A)(3)) and two years for a wrongful-death claim (§ 1053(A)). When the asbestos clock starts is set by a separate statute that applies notwithstanding any other provision of law: under the Asbestos and Silica Claims Priorities Act, 76 Okla. Stat. § 90.11, the period does not begin until the exposed person discovers, or through the exercise of reasonable diligence should have discovered, that he or she is physically impaired by an asbestos-related condition — so the clock can start before a formal diagnosis. The same Act treats a nonmalignant asbestos claim as a distinct cause of action from an asbestos cancer claim. Oklahoma also allows a claimant with a qualifying mesothelioma diagnosis to petition for an expedited trial setting (76 Okla. Stat. § 90.8(B)).
